The Laser Pointer in Your Mystery Box: 5 mW and the Law

A laser pointer is a small, cheap, common thing to find in an electronics mystery box, and one of the few items in it that can injure someone in a fraction of a second. The law caps a pointer at 5 milliwatts. Tests have found that most cheap green ones exceed it. Here is what the label should say, how to tell whether yours is over the line, and the rule that carries a prison sentence.
What the Law Says a Pointer Can Be
In the United States, lasers are regulated by the Food and Drug Administration under a performance standard that sorts them into classes by the power they emit. A pointer you buy for pointing, whether at a whiteboard or for a cat, must be Class IIIa, also written 3R, which means no more than 5 milliwatts of visible light. Below that sits Class II, under 1 milliwatt, the level of the scanner you meet at a supermarket till. Above it sit Class IIIb, up to 500 milliwatts, and Class IV, which burn. Neither of those may be sold to you as a pointer, and neither is safe in your hand.
Five milliwatts is the level at which your blink reflex is expected to protect you from a brief accidental exposure. It does not protect you from a deliberate stare, and it does not protect a child who does not know to look away. So even a legal pointer is not a toy, and a pointer that turns out to be stronger than legal is a hazard whatever the packaging shows.
Why the Cheap Green Ones Are the Problem
- A laser pointer sold in the US must be Class IIIa, 5 milliwatts or less; a federal test of cheap pointers found around nine in ten green ones and nearly half the red ones over the limit.

In 2013 the National Institute of Standards and Technology tested 122 laser pointers bought as consumer products, the kind you would find in a box like yours. About 90 percent of the green pointers and 44 percent of the red ones emitted more than the federal limit, some by a factor of ten or more. Several green units also emitted infrared light well above the limit, something you could never see, because the cheap way to make green is to convert an infrared laser and skip the filter that should block what is left. Infrared is invisible, your eye does not blink for it, and it can damage your retina without you feeling a thing.
Nothing about those pointers would have looked different to you from a compliant one. The label, where there was one, said 5 mW. That is the reason you should treat an unbranded green pointer from a random box as stronger than it says, and to keep it away from eyes as though it were.

Read the last two rows as the likely ones for the pointer in your box. A compliant laser carries a warning label with the class, the wavelength and the maximum output, and the maker's name. A pointer with a bare "5 mW" sticker and nothing else has told you only what the factory wanted you to read. You cannot measure the output at home, so you manage the pointer by assuming the worst and keeping the beam away from every eye.

The Rules That Are Not Optional
- Never at an aircraft. Aiming a laser at an aircraft, or its flight path, is a federal crime under 18 U.S.C. 39A, punishable by up to five years in prison, and the FAA logs more than ten thousand cockpit strikes a year. A green pointer at night reaches a cockpit miles away and fills it with light. People are prosecuted for this every month, and you would be traced.
- Never at a person. Not for a joke, not at a distance, not at a reflection. Eye injury is instant and permanent, to you or to them, and if you point a laser at someone it is an assault in most states.
- Never at a vehicle. A driver you dazzle at speed is a crash. Several states have specific laws for this.
- Never outdoors at night for fun. That is where you break the aircraft rule and the vehicle rule without intending to.
- Not for children. A laser pointer is not a toy, and toy laser products are limited to Class I, far below a pointer. If a child in your house ends up with one, take it.
For your cat, the pointer is fine at Class II or a genuine IIIa, on the floor, never near the animal's eyes, and never up toward a window.
What Counts as a Fault
A pointer with no compliance label is a non-compliant product, and you can report it to the seller as one, with a photograph of the item and its packaging, inside the window. A pointer that appears brighter than any pointer you have used, or one that leaves a visible spot on paper, is one to stop using and report as a safety issue.
